From 1st July 2022, all health and social care providers registered with the CQC must ensure that their staff receive training on interacting appropriately with people with a learning disability and autistic people at a level appropriate to their role. This new legal requirement is introduced by the Health and Care Act 2022.  The Government is required to consult and publish a Code of Practice, which would outline the content, delivery and ongoing monitoring and evaluation of the Oliver McGowan Mandatory Training that it has developed. It is anticipated that it will take at least 12 months to publish the Code of Practice. The CQC will provide statutory guidance until the Code of Practice is published. Ofsted and the Care Quality Commission present a new draft framework for inspecting provision for children and young people with SEND. On Monday 13th June 2022, Ofsted and the Care Quality Commission launched a consultation on proposals for a new joint framework for inspecting provision for children and young people with special education needs and disabilities (SEND) within a local area. These new inspections will be introduced in early 2023. The new frameworks will focus on the experiences and outcomes of children and young people with SEND. The proposals broaden the focus of inspection to look at whether local area partnerships are identifying and meeting the needs of children and young people with SEND and assess the impact on their lives and outcomes.
